Terms and Conditions

1. Agreement to These Terms

These Terms and Conditions ("Terms") govern your use of alltexexteriors.com (the "Website") and any estimate, proposal or service you request from All-Tex Home Improvement Services, LLC, doing business as All-Tex Exteriors ("All-Tex," "we," "us" or "our"). By using the Website or submitting a form, you agree to these Terms. If you do not agree, please do not use the Website.

Who we are: All-Tex Home Improvement Services, LLC, 4206 Pikard Way Ct, Spring, TX 77386. Phone: (281) 358-2553. Office hours: Monday to Friday, 8am to 6pm.

Definitions:

"Customer" or "you" means any person who uses the Website, requests an estimate or signs a contract with us.

"Project" means the home improvement work described in a signed written contract, such as patio covers, pergolas, screen enclosures, sunrooms, siding, roofing, windows, decks, outdoor kitchens, painting, room additions and related exterior work.

"Contract" means the signed written agreement for a specific Project, including its scope of work, price, payment schedule and any signed change orders.

If these Terms conflict with a signed Contract, the Contract controls for that Project.

2. Services, Estimates and Quotes

Free estimates. On-site consultations and estimates are free and do not obligate you to buy anything.

Estimates are not contracts. An estimate or proposal is a good-faith price based on what we can see at the time of the visit. No work is scheduled and no price is final until both parties sign a written Contract.

How long a quote is valid. Unless the proposal says otherwise, a written quote is valid for 30 days. After that, material costs, labor rates and availability may change the price.

Hidden conditions. Some problems only show once work begins. Examples include rotted framing or decking, termite damage, mold, out-of-code electrical or plumbing, and soil or slab problems. We will stop, show you the issue and give you a written change order before doing any extra work. You may approve or decline it.

Website content. Photos, project examples, product descriptions and prices on the Website are for general information only. They are not an offer. Finished colors, textures and materials may vary slightly from photos and samples.

Service area. We serve Houston and the surrounding communities. We may decline a project outside our service area or scope.

3. Contracts, Deposits and Payment

Written Contract required. Every Project needs a signed Contract that lists the scope of work, materials, price and payment schedule.

Deposit. A deposit may be due when the Contract is signed so we can order materials and reserve your crew. The amount appears in your Contract.

Payment schedule. Progress and final payments are due as stated in the Contract. The final payment is due when the work is substantially complete. Small punch-list items do not delay the final payment, but we will finish them promptly.

Late payment. Unpaid balances may be charged late fees or interest up to the amount Texas law allows. You also agree to pay reasonable collection costs and attorney's fees if we have to collect an overdue balance.

Liens. As a Texas contractor, we may have lien rights against the improved property for unpaid work under Chapter 53 of the Texas Property Code. We will give any notices that law requires.

Cancellation. If you signed the Contract at your home, you may have a right to cancel within 3 business days under Texas law. The Contract will explain how. After that period, if you cancel, you are responsible for custom-ordered materials and work already done, and the deposit may be kept to cover those costs.

Financing. We may offer financing through third-party lenders for qualified customers. Financing is subject to credit approval, and the lender's own terms apply. All-Tex is not the lender and does not decide credit approval. Call (281) 358-2553 for current terms and restrictions.

Insurance claims. If your Project is paid through an insurance claim, you are still responsible for the full Contract price, including any deductible and any amount your insurer does not pay. We do not waive, absorb or rebate deductibles, and we do not act as a public adjuster or negotiate claims for you.

4. Scheduling, Permits, Site Access and Changes

Scheduling. Start and finish dates are estimates. Weather, material shortages or delays, permit and HOA approval times, inspections, hidden conditions and other events beyond our control can delay a Project. We are not liable for those delays, and we will keep you informed.

Permits and HOA approval. We pull the building permits the Project requires unless the Contract says otherwise. You are responsible for getting any HOA or deed-restriction approval before work starts, unless we agree in writing to submit it for you.

Property lines and utilities. You are responsible for telling us where property lines, easements, sprinkler lines, septic systems, invisible pet fences and private underground lines are. We call 811 to mark public utilities before digging. We are not responsible for damage to unmarked private lines.

Site access. You agree to give our crews reasonable access to the work area, electricity and water during working hours. Please keep children and pets away from the work area. Move vehicles, furniture, décor and valuables away from the work area before work begins.

Normal wear on the property. Construction may cause minor, unavoidable effects such as lawn and landscaping disturbance near the work area, nail or debris fall-out and vibration. We clean up the job site daily and at completion and remove construction debris.

Change orders. Any change to the scope, materials or price must be in a written change order signed by you and All-Tex. A change order may change the price and the schedule.

Substitutions. If a specified material is discontinued or unavailable, we may substitute a product of equal or better quality after telling you.

5. Warranties, Liability and Indemnity

Workmanship warranty. Any workmanship warranty, its length and what it covers are stated in your Contract or warranty certificate. A workmanship warranty takes effect only after the Contract is paid in full.

Manufacturer warranties. Materials such as siding, roofing, windows and coatings carry the manufacturer's own warranty. We pass those warranties on to you, but All-Tex does not issue or guarantee them.

What warranties do not cover. Unless the Contract says otherwise, warranties do not cover damage from storms, hail, wind, flooding, fire, foundation movement or settling, lack of normal maintenance, misuse, alterations or repairs by others, or natural changes in wood and other materials, such as checking, shrinking and fading.

Making a claim. Report a warranty issue in writing within 30 days of finding it, and give us reasonable access to inspect and repair it. Under Chapter 27 of the Texas Property Code, you must give written notice of a claimed construction defect and allow us a chance to inspect and make an offer before filing a lawsuit.

Insurance. All-Tex carries insurance on every job. A certificate of insurance is available on request.

Limitation of liability. To the fullest extent allowed by law, All-Tex is not liable for indirect, incidental, special or consequential damages, such as lost use of the property, lost profits or temporary living costs. Our total liability for any claim about a Project will not exceed the amount you paid for that Project. Nothing in these Terms limits liability that cannot legally be limited, including for gross negligence or willful misconduct.

Indemnity. You agree to hold All-Tex harmless from claims caused by your own actions, by other contractors you hire, or by information you gave us that was inaccurate, such as property lines or private utilities.

6. Website Use, Communications and Privacy

Acceptable use. You agree not to misuse the Website. That includes submitting false information or someone else's contact details, sending spam or harmful code, scraping the Website, or trying to get unauthorized access to it.

Intellectual property. All Website content belongs to All-Tex or is used with permission. That includes text, photos, project images, logos, graphics and videos. You may not copy, republish or use it for commercial purposes without our written permission.

Calls, texts and emails. When you submit a form on the Website or give us your phone number, you agree that All-Tex may contact you at the number and email you provided. We may contact you by phone call, text message (SMS) and email about your estimate, appointment reminders, Project updates and related offers. Some calls and texts may be sent with automated technology. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply.

Opting out. Reply STOP to any text message to stop texts, or HELP for help. You can also ask us to stop calling or emailing you by calling (281) 358-2553. We do not sell or share your mobile number or SMS consent with third parties for their marketing.

Privacy. Our Privacy Policy explains how we collect, use and protect your information. It is part of these Terms.

Reviews and photos. If you post a review or testimonial about us, you allow us to share it, along with your first name and city, on the Website and in our marketing. We may photograph or record finished work at your property for our portfolio. We will not show your house number or personal details without your consent.

Third-party links. The Website may link to third-party sites, such as Facebook, YouTube, Pinterest, the BBB, Google and financing partners. We are not responsible for their content or policies.

No warranty for the Website. The Website is provided "as is." We do not promise it will always be available, current or free of errors.

7. Disputes, Governing Law and Contact

Talk to us first. If you have a concern, call or write to us first. Most issues can be solved quickly. Both parties agree to try in good faith to resolve a dispute informally for at least 30 days before taking legal action.

Governing law. These Terms and every Contract are governed by the laws of the State of Texas. Any lawsuit will be filed in the state courts of Montgomery County, Texas, unless the law requires a different venue.

Severability. If any part of these Terms is found unenforceable, the rest stays in effect.

No waiver. If we do not enforce a term right away, we have not given up the right to enforce it later.

Changes to these Terms. We may update these Terms at any time by posting the new version on this page with a new "Last updated" date. The Terms in effect when you sign a Contract apply to that Project.

Add a contact email; the site doesn't list one

Confirm the deposit, workmanship warranty length and the 30-day quote validity match how the client actually works

Add the SMS consent checkbox text to the Free Estimate form so it matches section 6 (needed for carrier/A2P 10DLC approval)
